Agreement between User and Nuna bubs
Welcome to https://www.nunabubs.com (the “Site”). The Site is operated by BUBS STORE LLC (“nuna bubs,” “we,” “our,” or “us”).
Your access to and use of the Site is conditioned on your acceptance of these Terms of Service (the “Terms”). By using the Site, you agree to be bound by the Terms. Please read them carefully and retain a copy for your records.
What we do.
nuna bubs is an online retail store offering baby and family products for purchase directly from our store.
1) Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information. Please review it carefully before using the Site.
2) Electronic Communications
By visiting the Site or sending us emails, you are communicating with us electronically and consent to receive communications from us electronically (email, notices posted on the Site, or other electronic means). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
3) Your Account
If you create an account, you’re responsible for maintaining the confidentiality of your login credentials and for restricting access to your device(s). You accept responsibility for all activities that occur under your account. We reserve the right, in our sole discretion, to refuse service, terminate accounts, remove or edit content, or cancel orders where we believe there is a violation of these Terms or suspected fraud.
4) Age Restrictions
You may not use or engage with the Site if you are under eighteen (18) years of age. By using the Site, you represent that you are at least 18 or that you are using the Site with the consent and supervision of a parent or legal guardian and that you are permitted by applicable law to use the Site.
5) Orders, Cancellations, Returns & Refunds
Order processing. Orders are typically processed within 24 hours (excluding weekends and holidays). You will receive a shipping confirmation email with tracking once your order ships.
Cancellations. Cancellations are accepted for full-priced items within 60 minutes of placing an order provided the order has not yet shipped. After shipment, please use the returns process.
Returns & refunds. You have 30 days from delivery to initiate a return for a refund or store credit, provided items are unused, in original condition and packaging. Unless the item was received damaged/incorrect, refunds are issued minus outbound shipping and return shipping costs (if we provide the label).
Some categories (e.g., certain sealed hygiene or baby items) may be non-returnable once opened for safety and hygiene reasons; see our Return Policy page for the current list.
Damaged or incorrect items. If your order arrives damaged or incorrect, email support@nunabubs.com within 7 days of delivery with your order number and clear photos of the issue. We’ll review case-by-case and work toward a prompt resolution (replacement, reshipment, or refund).
6) Shipping, Delivery & Tracking
Processing time: typically 24 hours after order confirmation.
Estimated delivery time (USA): 5–8 business days after shipment.
Tracking: You’ll receive a tracking number by email; allow up to 48 hours for the tracking link to activate.
Contact-free delivery. Our carriers may operate contact-free delivery, which means a signature may not be required. Please review the carrier’s current guidelines (linked in your tracking email).
If your order is late. If you have not received your order within 10 days of your shipping confirmation email, contact support@nunabubs.com with your name and order number so we can investigate.
P.O. Boxes. Some carriers limit delivery to P.O. Boxes. If your order cannot be delivered to a P.O. Box, we’ll contact you to arrange an alternative address.
7) Site Content & Intellectual Property
All content on the Site (text, graphics, logos, images, data compilations, and software) is owned by nuna bubs or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and make personal, non-commercial use of the Site. You may not copy, modify, reverse engineer, distribute, sell, license, or otherwise exploit any Site content without our prior written permission.
8) Acceptable Use
You agree not to use the Site for any unlawful purpose or in a way that could damage, disable, overburden, or impair the Site or interfere with others’ use. Prohibited content and activities include, without limitation:
- Fraudulent, defamatory, harassing, threatening, obscene, or otherwise unlawful material;
- Content that promotes hate or discrimination;
- Viruses, malware, or harmful code;
- Infringing content you don’t own or have rights to use;
- Violations of applicable laws, rules, or regulations.
9) User Submissions & Feedback
If you post, upload, or submit any content (e.g., reviews, feedback, suggestions) (“Submission”), you grant nuna bubs a non-exclusive, worldwide, royalty-free license to use, copy, modify, reproduce, display, distribute, and otherwise exploit such Submission in connection with the Site and our business. You represent and warrant that you own or control all rights in your Submission and that it does not infringe any third-party rights. We may remove Submissions at our discretion.
10) International Users
The Site is controlled and operated from the United States. If you access the Site from outside the U.S., you are responsible for compliance with local laws and agree not to use the Site in any manner prohibited by applicable laws, restrictions, or regulations.
11) Third-Party Links & Services
The Site may contain links to third-party websites or integrate third-party services. We are not responsible for the content, policies, or practices of those third parties and provide links for convenience only. Your use of third-party services is at your own risk and subject to their terms.
12) Disclaimer of Warranties
THE SITE, ITS CONTENT, AND ALL PRODUCTS AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUNA BUBS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUNA BUBS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, THE TERMS, OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) AT ISSUE OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.
(Some jurisdictions do not allow certain disclaimers or limitations; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.)
14) Indemnification
You agree to indemnify, defend, and hold harmless nuna bubs, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use or misuse of the Site; (b) your violation of these Terms; or (c) your violation of any third-party rights.
15) Dispute Resolution; Arbitration; Class Action Waiver
Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by emailing support@nunabubs.com. If we cannot resolve it within 30 days, either party may proceed to arbitration as set out below.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or products shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Dallas, Texas, before a single, neutral arbitrator. Judgment on the award may be entered in any court having jurisdiction. This clause is governed by the Federal Arbitration Act (FAA).
Class action waiver. YOU AND NUNA BUBS AGREE THAT ALL CLAIMS WILL BE BROUGHT ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON OR PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
Injunctive relief. Notwithstanding the foregoing, either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect its confidential information, intellectual property, or proprietary rights pending completion of arbitration.
16) Governing Law; Venue
Except to the extent preempted by federal law (including the FAA), these Terms and any dispute between you and nuna bubs shall be governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the arbitration provision, exclusive venue for any permitted court action will be the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction there.
17) Termination; Access Restriction
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to other users, us, or third parties.
18) Changes to the Terms
We may revise these Terms from time to time. When we do, we will update the “Last Updated” date below. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
